  • The Creating Hospitality Economic Enhancement for Restaurants and Servers (CHEERS) Act, a bipartisan bill from Reps. Darin LaHood (R-IL-16), Steven Horsford (D-NV-04), Suzan DelBene (D-WA-01) and Claudia Tenney (R-NY-24) and Sens. Maggie Hassan (D-NH) and Tim Sheehy (R-MT), will provide a tax deduction for bars, restaurants and entertainment venues to modernize or install draft systems.

  • This legislation will go a long way toward helping businesses that serve beer and other beverages on draft invest in their business and employees and drive commerce back to our favorite local bars and restaurants.

  • There are more than 16 million Americans working in the hospitality industry and there are more than 190,000 draft locations in the United States!

  • Restaurants, bars and venues continue to face high inflation, supply chain issues, and other logistical challenges. The CHEERS Act would offer beer retailers much-needed tax relief while incentivizing more environmentally conscious consumption.

  • Kegs are the most sustainable way to package beer:

  • Kegs have a 30+ year lifespan and save more than 400,000 metric tons of greenhouse gas emissions each year.

  • Using kegs keeps roughly 500,000 tons of packaging out of landfills each year.

CHEERS Act Talkers

  • Since 2005, the tax code has provided a deduction (known as Section 179D) for qualifying investments in energy-efficient systems on commercial premises.

  • Through the CHEERS Act, this provision would be expanded to apply to all new keg and tap properties, incentivizing the use of draft lines and keg equipment in taprooms, restaurants, bars and entertainment venues.

  • The legislation also would provide an additional benefit for the remodeling of draft property and for lost or stolen kegs.

  • Congress has modified definitions for qualifying property within the tax code several times in recent years to expand the scope of the deduction.

  • The CHEERS Act would include an incentive for energy-efficient draft containers and on-premise installation property were also included, providing immediate tax relief to struggling on-premise businesses.
